FaceMetric AI

We collect the following categories of information when you use FaceMetric AI:

What we do NOT collect: We do not collect, transmit, or store facial images, Face ID data, biometric identifiers, your identity, location, contacts, or any other personal information. No account is required to use FaceMetric AI.

We use the information we collect exclusively to:

• Provide, operate, and improve the features of FaceMetric AI;
• Authenticate your identity and manage your account (where applicable);
• Process subscription payments through RevenueCat (where applicable);
• Respond to your support requests;
• Diagnose technical issues using anonymous crash reports;
• Comply with applicable legal obligations.

We do not use your data for advertising targeting, sale to data brokers, or any purpose not listed above.

If you are located in the European Economic Area (EEA) or the United Kingdom, our legal basis for collecting and using personal data is:

• Performance of a contract — processing necessary to deliver the services you have requested (e.g., transcription, analysis);
• Legitimate interests — anonymous analytics and crash reporting to improve the app, where these interests are not overridden by your rights;
• Consent — where we explicitly ask for consent (e.g., HealthKit integration), you may withdraw it at any time.

We do not sell, rent, or trade your personal information. We share data only with the following service providers, solely to operate FaceMetric AI:

We may disclose your information if required by law, court order, or governmental authority, or to protect the rights, property, or safety of Evren Haznedaroglu, FaceMetric AI's users, or the public.

Because all analysis is on-device, we retain no personal data on our servers. Subscription status data is held by RevenueCat per their retention policy.

Depending on your jurisdiction, you may have the following rights regarding your personal data:

• Access — request a copy of the personal data we hold about you;
• Rectification — request correction of inaccurate data;
• Erasure — request deletion of your personal data ("right to be forgotten");
• Portability — receive your data in a structured, machine-readable format;
• Restriction — request that we restrict processing of your data;
• Objection — object to processing based on legitimate interests;
• Withdraw consent — where processing is based on consent, withdraw it at any time without affecting prior processing.

We implement industry-standard technical and organisational measures to protect your data, including:

• TLS 1.3 encryption for all data transmitted between the app and our servers;
• AES-256 encryption for data stored on our servers;
• Access controls limiting data access to authorised personnel only;
• Regular security reviews of our infrastructure.

No method of transmission or storage is 100% secure. If you believe your data has been compromised, contact us immediately at [email protected].

FaceMetric AI is not intended for users under 13. We do not knowingly collect data from children. Contact [email protected] if you believe a child's data has been collected.

We may update this Privacy Policy from time to time. We will notify you of material changes by updating the "Last updated" date above and, where required by law, providing additional notice (e.g., an in-app notification or email). Continued use of FaceMetric AI after changes constitute acceptance of the revised policy.

You acknowledge that this EULA is concluded solely between you and Evren Haznedaroglu, and not with Apple Inc. Evren Haznedaroglu is solely responsible for FaceMetric AI and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to FaceMetric AI.

In the event of any failure of FaceMetric AI to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for FaceMetric AI to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to FaceMetric AI.

Evren Haznedaroglu grants you a non-transferable, non-exclusive licence to use FaceMetric AI on any Apple-branded products that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions. You are permitted to use FaceMetric AI to analyse facial images using on-device AI and produce aesthetic metric reports.

You may not:

• Copy, modify, or distribute FaceMetric AI or any part of it;
• Reverse-engineer, decompile, or disassemble FaceMetric AI;
• Rent, lease, lend, sell, or sublicense FaceMetric AI;
• Remove or alter any proprietary notices or labels;
• Use FaceMetric AI for any unlawful purpose or in violation of any applicable laws or regulations.

The licence does not allow you to use FaceMetric AI on any device that you do not own or control, and you may not distribute or make FaceMetric AI available over a network where it could be used by multiple devices at the same time.

Certain features of FaceMetric AI are available only with an active subscription or one-time in-app purchase ("IAP"), processed through the Apple App Store. By purchasing a subscription or IAP:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period;
• Your Apple ID account will be charged upon confirmation of purchase;
• Subscription management and cancellation are available via iPhone Settings → Apple ID → Subscriptions;
• No refunds will be provided for any unused portion of a subscription period, except as required by applicable law or Apple's refund policies;
• Price changes will be communicated in advance and are subject to your consent at renewal.

Payment processing is handled by Apple and is subject to Apple's Terms of Service. Evren Haznedaroglu does not store your payment card details.

You agree that Evren Haznedaroglu may collect and use technical data and related information — including but not limited to technical information about your device, system software, and application software — that is gathered periodically to facilitate the provision of software updates, product support, and other services related to FaceMetric AI.

Evren Haznedaroglu may use this information, as long as it is in a form that does not personally identify you, to improve its products and services. Full details are set out in the Privacy Policy above.

FaceMetric AI operates entirely on-device. No external server connections are made for image analysis.

FaceMetric AI may enable access to third-party services and websites (collectively, "External Services"). You agree to use External Services at your sole risk. Evren Haznedaroglu is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such External Services.

By using FaceMetric AI, you acknowledge and agree that Evren Haznedaroglu is not responsible for any content, advertising, products, or other materials on or available from External Services. You further acknowledge and agree that Evren Haznedaroglu shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by use of, or reliance upon, any such content, goods, or services available on or through any External Services.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF FACEMETRIC AI IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FACEMETRIC AI AND ANY SERVICES PERFORMED OR PROVIDED BY FACEMETRIC AI ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. EVREN HAZNEDAROGLU HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO FACEMETRIC AI AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

EVREN HAZNEDAROGLU DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN OR SERVICES PERFORMED OR PROVIDED BY FACEMETRIC AI WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF FACEMETRIC AI OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN FACEMETRIC AI OR SERVICES WILL BE CORRECTED.

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL EVREN HAZNEDAROGLU BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, CORRUPTION OR LOSS OF DATA, FAILURE TO TRANSMIT OR RECEIVE ANY DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE FACEMETRIC AI, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF EVREN HAZNEDAROGLU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL EVREN HAZNEDAROGLU'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF FIFTY EUROS (€50.00).

Some jurisdictions do not allow the exclusion or limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you.

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

This EULA shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising under or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

If you are a consumer in the EU, you may also be entitled to pursue remedies under the laws of your country of residence.
